    Looks like two different things happened:

    • Briefing schedule set: “The opposed motion for an extension of time to file the opening brief and excerpts of record (Docket Entry No. 9) is granted. The opening brief and excerpts of record are due June 12, 2020. The answering brief is due within 28 days after service of the opening brief. The optional reply brief is due within 21 days after service of the answering brief. See 9th Cir. R. 3-3(b).”

    • The 2-1 ruling on the stay pending appeal. From the dissent: “Particularly given the very lopsided allocation of burdens and benefits occasioned by California’s wholly novel effort at ammunition background checks, the balance of equities, if anything, tips sharply against Appellant here. For these reasons, I would deny the request for a stay of the preliminary injunction. I respectfully dissent.”

    The panel was comprised of judges Silverman, Nguyen, and Collins.

    Note that Silverman and Nguyen voted 2-1 in the anti-constitutional direction. Barry G. Silverman is a Clinton appointee. Jacqueline H. Nguyen is an Obama appointee. Judge Daniel P. Collins was appointed by President Trump.
