The author is correct that #mediajackals enjoy no special First Amendment protection beyond what a humble blogger, Twitter user, etc. enjoys. And the author is also correct that if the #mediajackals created the New Rules (“Every peccadillo, no matter how minor or fleeting, must be unearthed and wielded to discredit our political enemies”), well, turnabout’s fair play.

His most interesting argument is that #mediajackals, Big Tech, and their enablers at the SPLC are engaging in cartel-like behavior. This is undoubtably true. The question is whether the antitrust laws punish this–not all cartel-like behavior can be remedied at law. It’s not price fixing, it’s not a market allocation scheme, it’s not limiting output, at least as I understand the claim.

On the other hand, President Trump’s Justice Department has a lot of lawyers who might enjoy a meaty assignment. Targeted leaks about this ongoing antitrust probe will be almost as useful as a complaint being filed, I’d say.
